General terms and conditions for the rental of La Maison du Puisatier

The purpose of these conditions is to inform our customers about the terms and conditions of accommodation, reservations, cancellations, the responsibilities of the parties and the management of the data we collect in the course of our business. Your privacy is important to us, and we protect the confidentiality of the personal information you provide to us. This information is not shared and is only used for administrative and practical purposes for your stay.

Acceptance of these conditions
Payment of the deposit implies acceptance of these General Terms and Conditions of Sale (GTCS) for the rental of the Maison du Puisatier.

The reservation becomes effective once the customer has sent the owner a deposit of 50% of the total price of the stay, with a minimum of three nights.

Rates
Prices are quoted in Euros, all taxes included, excluding tourist tax. These are the rates for bookings made directly with La Maison du Puisatier without an intermediary. Rates are for the entire house per night, up to a maximum of 6 people, for the chosen period.
Our rates and offers are subject to availability at the time of booking and may not be renewed for subsequent bookings. Conditions, rates and offers are subject to change.
As the atmosphere of the house changes frequently, the photos available on this site and on social networks are non-contractual.

Tourist tax
The tourist tax, when due, is a local tax that the customer must pay and that is paid by the owner to the Town Hall. It is payable per day and per person over 13 years of age. The amount of the tax is determined by a municipal decision of the commune of Uzès and will be specified at the time of booking.

Payment of stay
- 50% of the price of the stay upon reservation.
- 50% of the price of the stay 7 days before the date of stay.

Payment methods
We accept the following methods of payment: Credit card (Visa, MasterCard, American Express), SEPA bank transfer (Euros only), GooglePay, ApplePay.
AmenitizPay supports 3D Secure transactions and is fully PCI compliant.

Duration of stay
The tenant signing the present contract concluded for a fixed period may not, under any circumstances, claim any right to remain in the premises.

Cancellation by the customer
All cancellations must be notified by e-mail to the owner.
Cancellation before the start of the stay :
- Full refund for cancellations made at least 7 days before the arrival date.
- No refund for cancellations made within 7 days of arrival.
If the customer does not show up on the scheduled arrival date, the present contract becomes null and void.
The sum thus paid remains the property of the owner, who reserves the right to claim the balance of the price of the stay.
In the event of a shortened stay, the price corresponding to the initial stay remains the property of the owner.

For bookings made via AIRBNB, please refer to the terms and conditions stipulated on the site.

Cancellation by the owner
If the owner cancels the booking before the start of the stay, he must inform the customer by e-mail. The customer will be reimbursed immediately for any sums paid.
The owner also reserves the right to terminate the holiday early for serious reasons, such as theft, damage, inappropriate behavior or behavior not in keeping with the nature of the premises. In this case, the full amount of the stay remains due, without this payment precluding any legal proceedings.

Arrival
The customer must arrive on the specified day between 4pm and 9pm. In the event of late or delayed arrival, the customer must inform the owner.

Capacity
The present contract is drawn up for a specific number of people. Should the number of people accepted be exceeded, the owner reserves the right to refuse additional guests. This refusal cannot be considered as a modification or a breach of the contract at the owner's initiative, so that no reimbursement can be envisaged.

The contract
This contract is intended for the exclusive use of booking stays in a vacation home. The owner undertakes to welcome guests personally, or through one of his representatives (Art. D 324-13 of the French Tourism Code) with all due care to facilitate their stay and knowledge of the region.
The owner undertakes not to divulge to any third party any information of any kind whatsoever, on any medium whatsoever, that the tenant may have given him in the course of the performance of the present contract. However, these provisions do not apply to requests for information made by the authorities and/or the courts.

Insurance
The customer is responsible for all damage caused by himself.
The hirer certifies that he is insured by a civil liability policy covering his own liability.
La Maison du Puisatier certifies that it is covered by an insurance policy covering its civil and residential liability arising from its activity as a renter of furnished tourist accommodation.

Security deposit
The amount of the security deposit will be at most equivalent to that of the rental, without being able to exceed one month. As a general rule, it will be returned to the tenant on the day of departure, with the exception of cases where damage to the rented property has been noted during the departure inventory. In this case, the security deposit will be retained until the amount of the damage has been assessed, at which time an account will be drawn up between the parties based on the amount of the damage. In the event of loss or damage caused by the tenant to the furnished accommodation or equipment, the amount of the deposit will be reduced by the cost of repair or replacement. If the security deposit is insufficient, the tenant undertakes to pay the full amount after the departure inventory.

Animals
Pets and other animals are not allowed (except with the prior agreement of the tenant). Their presence would result in the immediate termination of the present contract, without this being considered as a modification or termination on the owner's initiative, so that in the event of the customer's departure, no reimbursement can be considered.

Pool safety
The owner accepts no responsibility for any accidents that occur while not complying with safety instructions. Tenants are responsible for supervising their children and complying with safety regulations.
Nb: safety instructions inherent in the use of the pool: no diving, no heckling on inflatables (or other) or around the pool, no running on the edge of the pool, etc

Disputes
Any complaint regarding the state of the premises must be submitted to the owner within three days of the start of the stay. Any other complaint relating to a stay must be made in writing as soon as possible. An amicable settlement will be proposed. In the event of persistent disagreement and in the absence of an amicable agreement, the dispute will be subject to French law and to the exclusive jurisdiction of the competent courts of the location of the rental, in this case the courts within the jurisdiction of the Nîmes bar.

Your stay :

Check in: Availability of the house
You will be able to access the house whenever you want from 4pm to 9pm. It is possible to leave your luggage between 11am and 4pm on request.

Check out: vacating the house
On the day of departure, the house must be vacated by 11am at the latest. I will be present to show you around the house and collect the keys. You must inform me in advance of your departure time.

Use and respect of the premises
The tenant-guest will enjoy the rental in a peaceful manner and will make good use of it. On departure, the tenant undertakes to leave the furnished rental property as clean as he/she found it on arrival. The client agrees not to smoke in the house (bedrooms, living room, windows, etc.) but only outside. Under no circumstances may the rental be used by third parties. The owner will provide the accommodation in accordance with its description and will maintain it in a state fit for use.
The broadcasting of music likely to cause a noise nuisance to the neighborhood is forbidden, as is noise in the garden after 10 pm.

Personal belongings
La Maison du Puisatier accepts no responsibility for theft, loss or damage to guests' personal belongings.
We recommend that you lock the garden gate when you are in the house.
If you forget your belongings in the house at the end of your stay, we can send them to the person concerned, at their request and expense.

Garbage cans
All rubbish must be deposited in the garbage cans at the bottom of rue de la Grande Bourgade, Place Tour du Roi, before you leave.
